Refugees and the German work permit

Studying, working and living in Germany or Austria

A work permit is required in order to be able to engage in gainful employment in Germany. In this article, we look at some of the conditions that apply to asylum seekers.

The possibility of obtaining a work permit for asylum seekers:

With a residence permit and proof of arrival, finding work is not an easy task. Self-employment is not allowed. You have to apply for a work permit at the immigration office in charge of your file.

A work permit can be granted if you have been living in Germany for three months and no longer wish to live in an initial asylum. If you have to stay in an initial asylum and you have minor children, you have to wait 6 months before you can get a work permit. Without minor children, this is possible after 9 months.

You will not be able to have a work permit if you have been refused because of another country of the European Union or if you come from a certain country of origin and your application has not been accepted after August 31, 2015.

It should be noted that the work permit for an asylum seeker is only issued for a specific job. The manager of the company that employs you must fill out a form to give a description of your job before you apply for the permit. Once the immigration office receives the completed forms, it has two weeks to respond. You can also go to the administrative court for an emergency application.

The case when you have a Tolerance (Duldung):

In case you have a Duldung, finding a job is not an easy task. Self-employment is not allowed. You have to apply for a work permit at the immigration office in charge of your application.

A work permit can be granted if you have lived in Germany for three months and are no longer living in an initial asylum. If you still have to live in an initial asylum, you will have to wait 6 months before you can get a work permit. 

You will be denied a work permit if you have refused to cooperate or lied to the authorities or if you are from a country of origin and your application for asylum, submitted after August 31, 2015, was denied.

The work permit you get will be issued for a specific job.Your employer must fill out a form to give the description of your job before you apply for the permit. Once the immigration office receives the completed forms, they have two weeks to respond. You can also apply to the administrative court for an emergency application.

If your asylum application is accepted:

When your asylum application is approved, you now acquire refugee status. You are now a person who can be self-employed or employed without any restrictions as a German citizen.

We have just seen that the labor market is open to refugees under certain conditions. It is possible to work in Germany if the application for asylum has been approved by the competent authorities and this gives the refugee the right to work in Germany with the same rights as native Germans.
